I'm forwarding an update on the fires in northern California from  
Maria Gilardin.

Maria's one-woman TUC radio project (TUCradio.org) has been an  
outstanding source of information on environmental and peace issues  
for years. She has also carried controversial material by some of the  
great dissidents of our times. TUC was one of the only sources to  
carry extensive coverage of the March, 2004 International Inquiry  
into 9/11 in San Francisco - the first major public inquiry into the  
event.

When not working on TUC radio, Maria has put much of her energy in  
recent years into moving off the grid and into a bale house in  
California.

WASHINGTON - A federal judge in California said Wednesday that the wiretapping law established by Congress was the "exclusive" means for the president to eavesdrop on Americans, and he rejected the government's claim that the president's constitutional authority as commander in chief trumped that law. The judge, Vaughn R. Walker, the chief judge for the Northern District of California, made his findings in a ruling on a lawsuit brought by an Oregon charity. The group says it has evidence of an illegal wiretap used against it by the National Security Agency under the secret surveillance program established by President Bush after the terrorist attacks of Sept. 11, 2001.

The Justice Department has tried for more than two years to kill the lawsuit, saying any surveillance of the charity or other entities was a "state secret" and citing the president's constitutional power as commander in chief to order wiretaps without a warrant from a court under the agency's program.

But Judge Walker, who was appointed to the bench by former President George Bush, rejected those central claims in his 56-page ruling. He said the rules for surveillance were clearly established by Congress in 1978 under the Foreign Intelligence Surveillance Act, which requires the government to get a warrant from a secret court.

 "Congress appears clearly to have intended to - and did - establish the exclusive means for foreign intelligence activities to be conducted," the judge wrote. "Whatever power the executive may otherwise have had in this regard, FISA limits the power of the executive branch to conduct such activities and it limits the executive branch's authority to assert the state secrets privilege in response to challenges to the legality of its foreign intelligence surveillance activities."

Judge Walker's voice carries extra weight because all the lawsuits involving telephone companies that took part in the N.S.A. program have been consolidated and are being heard in his court.

Jon Eisenberg, a lawyer for Al-Haramain Islamic Foundation, the plaintiff in the case, said the legal issues Judge Walker's ruling raised were significant. "He's saying FISA makes the rules and the president is bound by those rules," Mr. Eisenberg said.

A Justice Department official said the department was reviewing the opinion late Wednesday and would consider its options.

Officials at Al-Haramain say they were mistakenly given a government document revealing the N.S.A. operation. The Federal Bureau of Investigation demanded the document back, and Judge Walker's ruling made it more difficult for Al-Haramain to use what it claims to have seen . But he refused to throw out the lawsuit, giving the charity's lawyers 30 days to restructure their claim. "We still have our foot in the door," Mr. Eisenberg said. "The clock is a minute to midnight, but we've been there before and survived."

The ruling comes as the Senate is overhauling the foreign intelligence law. The measure would reaffirm FISA as the exclusive means for the president to order wiretaps through court warrants, but it would also provide legal immunity to phone companies involved in the eavesdropping program. A vote could come Tuesday.

The immunity issue would not directly affect this lawsuit because Al-Haramain is suing the government, not the phone companies. But the nearly 40 other lawsuits against phone companies that Judge Walker is overseeing would almost certainly have to be dismissed if immunity is signed into law, legal analysts say.

Fireworks can't hide U.S. atrocities




At a time when our collective consciousness has been assaulted by a
duplicitous government that arbitrarily assigns the status of a "rogue
nation" or "enemy combatant," while incessantly lying about its true
intentions, information and own lawlessness, how can we cavalierly
"celebrate" our nation's independence with picnics, parades and parties
as a demonstration of patriotism?


Will burgers, brats and beer
discharge the culpability of our silence in response to the senseless
slaughter of millions of innocent people? How can we enjoy traditional
festivities with our own families, knowing that millions of men, women
and children suffered incomprehensible losses, their lives utterly
destroyed?

Does a sporting event on a big-screen TV allow us to
relinquish our responsibility in what it is our government has done at
Abu Ghraib or Guantanamo Bay? Will the final score erase the barbaric
torture inflicted upon tens of thousands of innocent people, including
children, who have been denied any legal recourse to prove their
innocence?
 
Can a magnificent fireworks display justify our
pride in the "liberation" of millions of people we displaced, leaving
them homeless, without adequate food, shelter or medical care? Perhaps
the three-day weekend will exonerate us all from the billions of
taxpayer dollars -- needed for our own schools, health care and
infrastructure -- that dissipated amidst the sands of blood and oil
without a trace.

Can we just continue sleepwalking in this
unconscious state of denial and delusion until the election or January?
How many more people will we allow to be tortured, raped and murdered
in our name until "we" get around to making some changes within a
government infiltrated with corruption and controlled by thugs?
 
What will it take for Americans to actually stand up for the ideals
upon which this nation was originally founded?

It fascinates me how a "US" company can do things like this to increase 
plant efficiency overseas, but close plants in the US and repeatedly 
kill the economies of small cities and towns in their own country. Why 
isn't this being done here? Why aren't the gas hog plants in the US 
being re-tooled to build fuel-efficient vehicles? They might as well be 
giving every US citizen the finger behind their backs. If I were 
Janesville's City Manager (Mayor?) or the one in charge of any of the 
other towns affected, I would lead a charge to seize the plant via 
eminent domain and then have the local citizens start up a 
community-owned competitor to make vehicles and other heavy equipment 
that are highly efficient and make sense.

Mark Klein, the retired AT&T
engineer who stepped forward with the technical documents at the heart
of the anti-wiretapping case against AT&T, is furious at the
Senate's vote on Wednesday night to hold a vote on a bill intended to put an end to that lawsuit and more than 30 others.
?

[Wednesday]'s vote by Congress effectively gives retroactive
immunity to the telecom companies and? endorses an all-powerful
president. It?s a Congressional coup against the Constitution. The
Democratic leadership is touting the deal as a "compromise," but in
fact they have endorsed the infamous Nuremberg defense: "Just following
orders." The judge can only check their paperwork. This cynical deal is
a Democratic exercise in deceit and cowardice.

Klein saw a network monitoring room being built in AT&T's
internet switching center that only NSA-approved techs had access to.
He squirreled away documents and then presented them to the press and
the Electronic Frontier Foundation after news of the government's
warrantless wiretapping program broke.

Wired.com independently acquired a copy of the documents (.pdf) -- which were under court seal -- and published the wiring documents in May 2006 so that they could be evaluated.
The lawsuit that resulted from his documents is now waiting on the
9th U.S. Appeals Court to rule on whether it can proceed despite the
government saying the whole matter is a state secret. A lower court
judge ruled that it could, because the government admitted the program
existed and that the courts could handle evidence safely and in secret.

But the appeals court ruling will likely never see the light of day, since the Senate is set to vote on July 8 on the FISA Amendments Act of 2008,
which also largely legalizes Bush's warrantless wiretapping program by
expanding how the government can wiretap from inside the United States
without getting individualized court orders.

Klein continues:

Congress has made the FISA law a dead letter--such a law is useless
if the president can break it with impunity. Thus the Democrats have
surreptitiously repudiated the main reform of the post-Watergate era
and adopted Nixon?s line: "When the president does it that means that
it is not illegal." This is the judicial logic of a dictatorship.
The surveillance system now approved by Congress provides the
physical apparatus for the government to collect and store a huge
database on virtually the entire population, available for data mining
whenever the government wants to target its political opponents at any
given moment?all in the hands of an unrestrained executive power. It is
the infrastructure for a police state.
Neither the House nor the Senate has had Klein testify, nor have
telecom executives testified in open session about their participation.

The bill forces the district court judge handling the consolidated
cases against telecoms to dismiss the suits if the Attorney General
certifies that a government official sent a written request to a phone
or internet provider, saying that the President approved the program
and his lawyers deemed it legal. Judge Vaughn Walker of the California

This is an amazing presentation. It is 75 minutes long, but if you start it, I don't think you will want to stop. I could not. The speaker is a conservative Baptist missionary, but he does not speak about religion. I cannot recommend it highly enough. It will make you think and ponder on how much is believable:

WE know what a criminal White House looks like from "The Final Days," Bob 
Woodward and Carl Bernstein?s classic account of Richard Nixon?s unraveling. The 
cauldron of lies, paranoia and illegal surveillance boiled over, until it was 
finally every man for himself as desperate courtiers scrambled to save their 
reputations and, in a few patriotic instances, their country.


"The Final Days" was published in 1976, two years after Nixon abdicated in 
disgrace. With the Bush presidency, no journalist (or turncoat White House 
memoirist) is waiting for the corpse to be carted away. The latest and perhaps most 
chilling example arrives this week from Jane Mayer of The New Yorker, long a 
relentless journalist on the war-on-terror torture beat. Her book "The Dark 
Side" connects the dots of her own past reporting and that of her top-tier 
colleagues (including James Risen and Scott Shane of The New York Times) to portray 
a White House that, like its prototype, savaged its enemies within almost as 
ferociously as it did the Constitution.

Some of "The Dark Side" seems right out of "The Final Days," minus Nixon?s 
operatic boozing and weeping. We learn, for instance, that in 2004 two 
conservative Republican Justice Department officials had become "so paranoid" that 
"they actually thought they might be in physical danger." The fear of being 
wiretapped by their own peers drove them to speak in code.

The men were John Ashcroft?s deputy attorney general, James Comey, and an 
assistant attorney general, Jack Goldsmith. Their sin was to challenge the White 
House?s don, Dick Cheney, and his consigliere, his chief of staff David 
Addington, when they circumvented the Geneva Conventions to make torture the covert 
law of the land. Mr. Comey and Mr. Goldsmith failed to stop the "torture 
memos" and are long gone from the White House. But Vice President Cheney and Mr. 
Addington remain enabled by a president, attorney general (Michael Mukasey) and 
C.I.A. director (Michael Hayden) who won?t shut the door firmly on torture 
even now.

Nixon parallels take us only so far, however. "The Dark Side" is scarier than 
"The Final Days" because these final days aren?t over yet and because the 
stakes are much higher. Watergate was all about a paranoid president?s 
narcissistic determination to cling to power at any cost. In Ms. Mayer?s portrayal of 
the Bush White House, the president is a secondary, even passive, figure, and 
the motives invoked by Mr. Cheney to restore Nixon-style executive powers are 
theoretically selfless. Possessed by the ticking-bomb scenarios of television?s 
"24," all they want to do is protect America from further terrorist strikes.

So what if they cut corners, the administration?s last defenders argue. While 
prissy lawyers insist on habeas corpus and court-issued wiretap warrants, the 
rest of us are being kept safe by the Cheney posse.

But are we safe? As Al Qaeda and the Taliban surge this summer, that single 
question is even more urgent than the moral and legal issues attending torture.

On those larger issues, the evidence is in, merely awaiting adjudication. Mr. 
Bush?s 2005 proclamation that "we do not torture" was long ago revealed as a 
lie. Antonio Taguba, the retired major general who investigated detainee abuse 
for the Army, concluded that "there is no longer any doubt" that "war crimes 
were committed." Ms. Mayer uncovered another damning verdict: Red Cross 
investigators flatly told the C.I.A. last year that America was practicing torture 
and vulnerable to war-crimes charges.

Top Bush hands are starting to get sweaty about where they left their 
fingerprints. Scapegoating the rotten apples at the bottom of the military?s barrel 
may not be a slam-dunk escape route from accountability anymore. 

No wonder the former Rumsfeld capo, Douglas Feith, is trying to discredit a 
damaging interview he gave to the British lawyer Philippe Sands for another 
recent and essential book on what happened, "Torture Team." After Mr. Sands 
previewed his findings in the May issue of Vanity Fair, Mr. Feith protested he had 
been misquoted ? apparently forgetting that Mr. Sands had taped the interview. 
Mr. Feith and Mr. Sands are scheduled to square off in a House hearing this 
Tuesday.

So hot is the speculation that war-crimes trials will eventually follow in 
foreign or international courts that Lawrence Wilkerson, Colin Powell?s former 
chief of staff, has publicly advised Mr. Feith, Mr. Addington and Alberto 
Gonzales, among others, to "never travel outside the U.S., except perhaps to Saudi 
Arabia and Israel." But while we wait for the wheels of justice to grind 
slowly, there are immediate fears to tend. Ms. Mayer?s book helps cement the case 
that America?s use of torture has betrayed not just American values but our 
national security, right to the present day. 

In her telling, a major incentive for Mr. Cheney?s descent into the dark side 
was to cover up for the Bush White House?s failure to heed the Qaeda threat 
in 2001. Jack Cloonan, a special agent for the F.B.I.?s Osama bin Laden unit 
until 2002, told Ms. Mayer that Sept. 11 was "all preventable." By March 2000, 
according to the C.I.A.?s inspector general, "50 or 60 individuals" in the 
agency knew that two Al Qaeda suspects ? soon to be hijackers ? were in America. 
But there was no urgency at the top. Thomas Pickard, the acting F.B.I. 
director that summer, told Ms. Mayer that when he expressed his fears about the Qaeda 
threat to Mr. Ashcroft, the attorney general snapped, "I don?t want to hear 
about that anymore!" 

After 9/11, our government emphasized "interrogation over due process," Ms. 
Mayer writes, "to pre-empt future attacks before they materialized." But in 
reality torture may well be enabling future attacks. This is not just because Abu 
Ghraib snapshots have been used as recruitment tools by jihadists. No less 
destructive are the false confessions inevitably elicited from tortured 
detainees. The avalanche of misinformation since 9/11 has compromised prosecutions, 
allowed other culprits to escape and sent the American military on wild-goose 
chases. The coerced "confession" to the murder of the Wall Street Journal 
reporter Daniel Pearl by Khalid Sheikh Mohammed, to take one horrific example, may 
have been invented to protect the real murderer. 

The biggest torture-fueled wild-goose chase, of course, is the war in Iraq. 
Exhibit A, revisited in "The Dark Side," is Ibn al-Shaykh al-Libi, an accused 
Qaeda commander whose torture was outsourced by the C.I.A. to Egypt. His 
fabricated tales of Saddam?s biological and chemical W.M.D. ? and of nonexistent 
links between Iraq and Al Qaeda ? were cited by President Bush in his fateful 
Oct. 7, 2002, Cincinnati speech ginning up the war and by Mr. Powell in his subs
equent United Nations presentation on Iraqi weaponry. Two F.B.I. officials 
told Ms. Mayer that Mr. al-Libi later explained his lies by saying: "They were 
killing me. I had to tell them something."

That "something" was crucial in sending us into the quagmire that, five years 
later, has empowered Iran and compromised our ability to counter the very 
terrorists that torture was supposed to thwart. As The Times reported two weeks 
ago, Iraq has monopolized our military and intelligence resources to the point 
where we don?t have enough predator drones or expert C.I.A. field agents to 
survey the tribal areas where terrorists are amassing in Pakistan. Meanwhile, 
the threat to America from Al Qaeda is "comparable to what it faced on Sept. 11, 
2001," said Seth Jones, a RAND Corporation terrorism expert and Pentagon 
consultant. The difference between now and then is simply that the base of 
operations has moved, "roughly the difference from New York to Philadelphia."

Yet once again terrorism has fallen off America?s map, landing at or near the 
bottom of voters? concerns in recent polls. There were major attacks in rapid 
succession last week in Pakistan, Afghanistan (the deadliest in Kabul since 
we "defeated" the Taliban in 2001) and at the American consulate in Turkey . 
Who listened to this ticking time bomb? It?s reminiscent of July 2001, when few 
noticed that the Algerian convicted of trying to bomb Los Angeles 
International Airport on the eve of the millennium testified that he had been trained in 
bin Laden?s Afghanistan camps as part of a larger plot against America. 
In last Sunday?s Washington Post, the national security expert Daniel 
Benjamin sounded an alarm about the "chronic" indecisiveness and poor execution of 
Bush national security policy as well as the continuing inadequacies of the 
Department of Homeland Security. Mr. Benjamin must feel a sinking sense of d?j? 
vu. Exactly seven years ago in the same newspaper, just two months before 9/11, 
he co-wrote an article headlined "Defusing a Time Bomb" imploring the Bush 
administration in vain to pay attention to Afghanistan because that country?s 
terrorists "continue to pose the most dangerous threat to American lives." 

And so we?re back where we started in the summer of 2001, with even shark 
attacks and Chandra Levy?s murder (courtesy of a new Washington Post 
investigation) returning to the news . We are once again distracted and unprepared while 
the Taliban and bin Laden?s minions multiply in Afghanistan and Pakistan. This, 
no less than the defiling of the Constitution, is the legacy of an 
administration that not merely rationalized the immorality of torture but shackled our 
national security to the absurdity that torture could easily fix the terrorist 
threat. 

That?s why the Bush White House?s corruption in the end surpasses Nixon?s. 
We can no longer take cold comfort in the Watergate maxim that the cover-up was 
worse than the crime. This time the crime is worse than the cover-up, and the 
punishment could rain down on us all.

PS: It may be wise to look through the VA report in case some anomaly 
was missed in the above assessment. FYI, I skimmed through some of the 
VA report, and found this under "Gulf War Mortality Data 1990-1997 on 
page 16 hich has 4506 counted as dead. But there is a twist, as revealed 
by this quote:  This report, supplied by VHA, shows death rates from 
1990 to 1997 of US Gulf War veterans deployed to the Gulf War region 
before March 1, 1991 compared to non-Gulf War veterans over the same 
period.

It's not realistic to expect corporations to sell cheaper at home than they can get on the global market.  That said, we shouldn't subsidize companies who won't give the U.S. taxpayers a return on their subsidy investment.

Reducing consumption is likely the best way to fix the problem.  Eliminate subsidies, reduce consumption, and let the corporations sell their product in a way that maximizes profit -- then tax that profit at a responsible rate.

I am beginning to wonder if a system that monetizes our fundamental  
interactions with one another is a major obstacle to peace, justice,  
and sustainability.

MY two cents for this thread:

The root of our problem does not lie with "corporations" - unless we are 
talking about the privately owned central banking corporations which 
control EVERYTHING ESLE:

interactions with one another". Rather it monetizes exponentially 
increasing DEBT, due to the way our money is created. Money is defined 
as a "medium of exchange" and, properly issued, it is used to serve the 
needs of the people. Currently, it is issued by the banking system to 
serve the needs of the stockholders of the system.

This is a GLOBAL SYSTEM. Main operational apparatus include the Bank of 
International Settlements, the UN - and its organs like the IMF and 
World Bank - the various misnamed free trade (investment) agreements and 
more. Main tools of the global system include private (corporate 
banking) control of the global (and US) money supply, use of tax exempt 
foundations to spread propaganda, money trust control of media, 
education and government, secret and semi-secret societies - including 
the Council on Foreign Relations and Bilderberg, and more. ALL well 
documented but essentially lost in a sea of dis- information.

least those prices not skewed by speculation or those who make price

happens to the value of our money once interest charges become embedded 
into the cost of goods and services:

Bottom line is that the WHOLE SCHEME has NOTHING WHATSOEVER to do with 
"free" markets - or capitalism!! For Ex, gold prices are set each day 
out of London and Zurich, oil prices out of New York and London, and so 
on. Commodities are, and have long been, priced by the global rulers if 
you want to look at it that way, but most assuredly NOT by "Free" markets.

What we have going on now has NOTHING to do with capitalism or any other 
"ism" unless you want to call it totalitarian socialism (for the rich). 
It is now and has for centuries all been rigged by the money powers. 
Actually what we have going on now is WAY worse than Capitalism which 
may only have been a stepping stone if you will.

Today we are going through a "redesign of the global credit system" if 
Bill Gross and other luminaries are to be believed. For us that means is 
yet another bankruptcy reorganization, and more actual slavery not to 
mention endless war - all due to our money system!

I try to show how this happened in my book The Two Faces of Money, and I 
am in the process of working on a project, currently in the form of a 
slide presentation which may need to become a book called "Introducing 
the One World Order". If anyone is interested in critiquing what I have 
so far, let me know and I'll send a copy. It is meant to be a 
continuation of my book, and it is scary! (But as I say in the first 
book, if we don't know what the problem is we won't be able to solve it.)

In any case anD again, it is a global system, part of the ONE WORLD 
Economic police state staring us in the face:

Remember, the first responders' broken Motorola radios contracted 
(knowingly) by Giuliani--which killed firefighters who never got the 
evacuate message--and now contracted for responders by Dept of Homeland 
Security, which is still killing firefighters who can't hear commanders' 
directions while they're inside buildings trying to save our lies ... 
book "Radio Silence" by firefighters documents all of this... tragic.

The carnage just goes on and on and on... so sad.

Two apparently unrelated articles from CLG.

But, there have also been reports of a July 7, 2008 forced landing of a plane 
carrying Obama, largely unreported as far as I know.  (If anyone has a 
reputable link to that, I would appreciate your sending it to me.)  

And, what is the underlying meaning of all these drills?  Legitmate and good 
preparation?  Over-reactive, but genuine?  Sensitization? Cover-up and 
forewarning?

We've seen examples of  amazingly synchronous drills/real terror events 
before.

Exposing Bush's historic abuse of power
Salon has uncovered new evidence of post-9/11 spying on Americans. Obtained 
documents point to a potential investigation of the White House that could 
rival Watergate.

Jul. 23, 2008 | The last several years have brought a parade of dark 
revelations about the George W. Bush administration, from the manipulation of 
intelligence to torture to extrajudicial spying inside the United States. But there 
are growing indications that these known abuses of power may only be the tip of 
the iceberg. Now, in the twilight of the Bush presidency, a movement is 
stirring in Washington for a sweeping new inquiry into White House malfeasance that 
would be modeled after the famous Church Committee congressional investigation 
of the 1970s. 

While reporting on domestic surveillance under Bush, Salon obtained a 
detailed memo proposing such an inquiry, and spoke with several sources involved in 
recent discussions around it on Capitol Hill. The memo was written by a former 
senior member of the original Church Committee; the discussions have included 
aides to top House Democrats, including Speaker Nancy Pelosi and Judiciary 
Committee chairman John Conyers, and until now have not been disclosed publicly. 

Salon has also uncovered further indications of far-reaching and possibly 
illegal surveillance conducted by the National Security Agency inside the United 
States under President Bush. That includes the alleged use of a top-secret, 
sophisticated database system for monitoring people considered to be a threat to 
national security. It also includes signs of the NSA's working closely with 
other U.S. government agencies to track financial transactions domestically as 
well as globally. 

The proposal for a Church Committee-style investigation emerged from talks 
between civil liberties advocates and aides to Democratic leaders in Congress, 
according to sources involved. (Pelosi's and Conyers' offices both declined to 
comment.) Looking forward to 2009, when both Congress and the White House may 
well be controlled by Democrats, the idea is to have Congress appoint an 
investigative body to discover the full extent of what the Bush White House did in 
the war on terror to undermine the Constitution and U.S. and international 
laws. The goal would be to implement government reforms aimed at preventing 
future abuses -- and perhaps to bring accountability for wrongdoing by Bush 
officials. 

"If we know this much about torture, rendition, secret prisons and 
warrantless wiretapping despite the administration's attempts to stonewall, then imagine 
what we don't know," says a senior Democratic congressional aide who is 
familiar with the proposal and has been involved in several high-profile 
congressional investigations. 
"You have to go back to the McCarthy era to find this level of abuse," says 
Barry Steinhardt, the director of the Program on Technology and Liberty for the 
American Civil Liberties Union. "Because the Bush administration has been so 
opaque, we don't know [the extent of] what laws have been violated." 
The parameters for an investigation were outlined in a seven-page memo, 
written after the former member of the Church Committee met for discussions with 
the ACLU, the Center for Democracy and Technology, Common Cause and other 
watchdog groups. Key issues to investigate, those involved say, would include the 
National Security Agency's domestic surveillance activities; the Central 
Intelligence Agency's use of extraordinary rendition and torture against terrorist 
suspects; and the U.S. government's extensive use of military assets -- 
including satellites, Pentagon intelligence agencies and U2 surveillance planes -- for 
a vast spying apparatus that could be used against the American people. 

Specifically, the ACLU and other groups want to know how the NSA's use of 
databases and data mining may have meshed with other domestic intelligence 
activities, such as the U.S. government's extensive use of no-fly lists and the 
Treasury Department's list of "specially designated global terrorists" to identify 
potential suspects. As of mid-July, says Steinhardt, the no-fly list includes 
more than 1 million records corresponding to more than 400,000 names. If 
those people really represent terrorist threats, he says, "our cities would be 
ablaze." A deeper investigation into intelligence abuses should focus on how 
these lists feed on each other, Steinhardt says, as well as the government's 
"inexorable trend towards treating everyone as a suspect." 

"It's not just the 'Terrorist Surveillance Program,'" agrees Gregory T. 
Nojeim from the Center for Democracy and Technology, referring to the Bush 
administration's misleading name for the NSA's warrantless wiretapping program. "We 
need a broad investigation on the way all the moving parts fit together. It 
seems like we're always looking at little chunks and missing the big picture." 

A prime area of inquiry for a sweeping new investigation would be the Bush 
administration's alleged use of a top-secret database to guide its domestic 
surveillance. Dating back to the 1980s and known to government insiders as "Main 
Core," the database reportedly collects and stores -- without warrants or court 
orders -- the names and detailed data of Americans considered to be threats 
to national security. 

According to several former U.S. government officials with extensive 
knowledge of intelligence operations, Main Core in its current incarnation apparently 
contains a vast amount of personal data on Americans, including NSA intercepts 
of bank and credit card transactions and the results of surveillance efforts 
by the FBI, the CIA and other agencies. One former intelligence official 
described Main Core as "an emergency internal security database system" designed 
for use by the military in the event of a national catastrophe, a suspension of 
the Constitution or the imposition of martial law. Its name, he says, is 
derived from the fact that it contains "copies of the 'main core' or essence of 
each item of intelligence information on Americans produced by the FBI and the 
other agencies of the U.S. intelligence community." 
Some of the former U.S. officials interviewed, although they have no direct 
knowledge of the issue, said they believe that Main Core may have been used by 
the NSA to determine who to spy on in the immediate aftermath of 9/11. 
Moreover, the NSA's use of the database, they say, may have triggered the now-famous 
March 2004 confrontation between the White House and the Justice Department 
that nearly led Attorney General John Ashcroft, FBI director William Mueller and 
other top Justice officials to resign en masse. 
The Justice Department officials who objected to the legal basis for the 
surveillance program -- former Deputy Attorney General James B. Comey and Jack 
Goldsmith, the former head of the Office of Legal Counsel -- testified before 
Congress last year about the 2004 showdown with the White House. Although they 
refused to discuss the highly classified details behind their concerns, the New 
York Times later reported that they were objecting to a program that "involved 
computer searches through massive electronic databases" containing "records 
of the phone calls and e-mail messages of millions of Americans." 

According to William Hamilton, a former NSA intelligence officer who left the 
agency in the 1970s, that description sounded a lot like Main Core, which he 
first heard about in detail in 1992. Hamilton, who is the president of Inslaw 
Inc., a computer services firm with many clients in government and the private 
sector, says there are strong indications that the Bush administration's 
domestic surveillance operations use Main Core. 
Hamilton's company Inslaw is widely respected in the law enforcement 
community for creating a program called the Prosecutors' Management Information 
System, or PROMIS. It keeps track of criminal investigations through a powerful 
search engine that can quickly access all stored data components of a case, from 
the name of the initial investigators to the telephone numbers of key suspects. 
PROMIS, also widely used in the insurance industry, can also sort through 
other databases fast, with results showing up almost instantly. "It operates just 
like Google," Hamilton told me in an interview in his Washington office in 
May. 

Since the late 1980s, Inslaw has been involved in a legal dispute over its 
claim that Justice Department officials in the Reagan administration 
appropriated the PROMIS software. Hamilton claims that Reagan officials gave PROMIS to 
the NSA and the CIA, which then adapted the software -- and its outstanding 
ability to search other databases -- to manage intelligence operations and track 
financial transactions. Over the years, Hamilton has employed prominent lawyers 
to pursue the case, including Elliot Richardson, the former attorney general 
and secretary of defense who died in 1999, and C. Boyden Gray, the former 
White House counsel to President George H.W. Bush. The dispute has never been 
settled. But based on the long-running case, Hamilton says he believes U.S. 
intelligence uses PROMIS as the primary software for searching the Main Core 
database. 

Hamilton was first told about the connection between PROMIS and Main Core in 
the spring of 1992 by a U.S. intelligence official, and again in 1995 by a 
former NSA official. In July 2001, Hamilton says, he discussed his case with 
retired Adm. Dan Murphy, a former military advisor to Elliot Richardson who later 
served under President George H.W. Bush as deputy director of the CIA. Murphy, 
who died shortly after his meeting with Hamilton, did not specifically 
mention Main Core. But he informed Hamilton that the NSA's use of PROMIS involved 
something "so seriously wrong that money alone cannot cure the problem," 
Hamilton told me. He added, "I believe in retrospect that Murphy was alluding to Main 
Core." Hamilton also provided copies of letters that Richardson and Gray sent 
to U.S. intelligence officials and the Justice Department on Inslaw's behalf 
alleging that the NSA and the CIA had appropriated PROMIS for intelligence 
use. 
Hamilton says James B. Comey's congressional testimony in May 2007, in which 
he described a hospitalized John Ashcroft's dramatic standoff with senior Bush 
officials Alberto Gonzales and Andrew Card, was another illuminating moment. 
"It was then that we [at Inslaw] started hearing again about the Main Core 
derivative of PROMIS for spying on Americans," he told me. 
Through a former senior Justice Department official with more than 25 years 
of government experience, Salon has learned of a high-level former national 
security official who reportedly has firsthand knowledge of the U.S. government's 
use of Main Core. The official worked as a senior intelligence analyst for a 
large domestic law enforcement agency inside the Bush White House. He would 
not agree to an interview. But according to the former Justice Department 
official, the former intelligence analyst told her that while stationed at the White 
House after the 9/11 attacks, one day he accidentally walked into a 
restricted room and came across a computer system that was logged on to what he r
ecognized to be the Main Core database. When she mentioned the specific name of the 
top-secret system during their conversation, she recalled, "he turned white as 
a sheet." 
An article in Radar magazine in May, citing three unnamed former government 
officials, reported that "8 million Americans are now listed in Main Core as 
potentially suspect" and, in the event of a national emergency, "could be 
subject to everything from heightened surveillance and tracking to direct 
questioning and even detention." 
The alleged use of Main Core by the Bush administration for surveillance, if 
confirmed to be true, would indicate a much deeper level of secretive 
government intrusion into Americans' lives than has been previously known. With 
respect to civil liberties, says the ACLU's Steinhardt, it would be "pretty 
frightening stuff." 

The Inslaw case also points to what may be an extensive role played by the 
NSA in financial spying inside the United States. According to reports over the 
years in the U.S. and foreign press, Inslaw's PROMIS software was embedded 
surreptitiously in systems sold to foreign and global banks as a way to give the 
NSA secret "backdoor" access to the electronic flow of money around the world. 


In May, I interviewed Norman Bailey, a private financial consultant with 
years of government intelligence experience dating from the George W. Bush 
administration back to the Reagan administration. According to Bailey -- who from 
2006 to 2007 headed a special unit within the Office of the Director of National 
Intelligence focused on financial intelligence on Cuba and Venezuela -- the 
NSA has been using its vast powers with signals intelligence to track financial 
transactions around the world since the early 1980s. 
>From 1982 to 1984, Bailey ran a top-secret program for President Reagan's 
National Security Council, called "Follow the Money," that used NSA signals 
intelligence to track loans from Western banks to the Soviet Union and its allies. 
PROMIS, he told me, was "the principal software element" used by the NSA and 
the Treasury Department then in their electronic surveillance programs tracking 
financial flows to the Soviet bloc, organized crime and terrorist groups. His 
admission is the first public acknowledgement by a former U.S. intelligence 
official that the NSA used the PROMIS software. 
According to Bailey, the Reagan program marked a significant shift in 
resources from human spying to electronic surveillance, as a way to track money flows 
to suspected criminals and American enemies. "That was the beginning of the 
whole process," he said. 
After 9/11, this capability was instantly seen within the U.S. government as 
a critical tool in the war on terror -- and apparently was deployed by the 
Bush administration inside the United States, in cases involving alleged 
terrorist supporters. One such case was that of the Al-Haramain Islamic Foundation in 
Oregon, which was accused of having terrorist ties after the NSA, at the 
request of the Treasury Department, eavesdropped on the phone calls of Al-Haramain 
officials and their American lawyers. The charges against Al-Haramain were 
based primarily on secret evidence that the Bush administration refused to 
disclose in legal proceedings; Al-Haramain's lawyers argued in a lawsuit that was a 
violation of the defendants' due process rights. 

According to Bailey, the NSA also likely would have used its technological 
capabilities to track the charity's financial activity. "The vast majority of 
financial movements of any significance take place electronically, so intercepts 
have become an extremely important element" in intelligence, he explained. 
"If the government suspects that a particular Muslim charitable organization is 
engaged in collecting funds to funnel to terrorists, the NSA would be asked to 
follow the money going into and out of the bank accounts of that charity." 
(The now-defunct Al-Haramain Foundation, although affiliated with a Saudi 
Arabian-based global charity, was founded and based in Ashland, Ore.) 

The use of a powerful database and extensive watch lists, Bailey said, would 
make the NSA's job much easier. "The biggest problems with intercepts, quite 
frankly, is that the volumes of data, daily or even by the hour, are gigantic," 
he said. "Unless you have a very precise idea of what it is you're looking 
for, the NSA people or their counterparts [overseas] will just throw up their 
hands and say 'forget it.'" Regarding domestic surveillance, Bailey said there's 
a "whole gray area where the initiation of the transaction was in the United 
States and the final destination was outside, or vice versa. That's something 
for the lawyers to figure out." 

Bailey's information on the evolution of the Reagan intelligence program 
appears to corroborate and clarify an article published in March in the Wall 
Street Journal, which reported that the NSA was conducting domestic surveillance 
using "an ad-hoc collection of so-called 'black programs' whose existence is 
undisclosed." Some of these programs began "years before the 9/11 attacks but 
have since been given greater reach." Among them, the article said, are a joint 
NSA-Treasury database on financial transactions that dates back "about 15 
years" to 1993. That's not quite right, Bailey clarified: "It started in the early 
'80s, at least 10 years before." 
Main Core may be the contemporary incarnation of a government watch list 
system that was part of a highly classified "Continuity of Government" program 
created by the Reagan administration to keep the U.S. government functioning in 
the event of a nuclear attack. Under a 1982 presidential directive, the 
outbreak of war could trigger the proclamation of martial law nationwide, giving the 
military the authority to use its domestic database to round up citizens and 
residents considered to be threats to national security. The emergency measures 
for domestic security were to be carried out by the Federal Emergency 
Management Agency (FEMA) and the Army. 
In the late 1980s, reports about a domestic database linked to FEMA and the 
Continuity of Government program began to appear in the press. For example, in 
1986 the Austin American-Statesman uncovered evidence of a large database that 
authorities were proposing to use to intern Latino dissidents and refugees 
during a national emergency that might follow a potential U.S. invasion of 
Nicaragua. During the Iran-Contra congressional hearings in 1987, questions to 
Reagan aide Oliver North about the database were ruled out of order by the 
committee chairman, Democratic Sen. Daniel Inouye, because of the "highly sensitive 
and classified" nature of FEMA's domestic security operations. 

In September 2001, according to "The Rise of the Vulcans," a 2004 book on 
Bush's war cabinet by James Mann, a contemporary version of the Continuity of 
Government program was put into play in the hours after the 9/11 terrorist 
attacks, when Vice President Cheney and senior members of Congress were dispersed to 
"undisclosed locations" to maintain government functions. It was during this 
emergency period, Hamilton and other former government officials believe, that 
President Bush may have authorized the NSA to begin actively using the Main 
Core database for domestic surveillance. One indicator they cite is a statement 
by Bush in December 2005, after the New York Times had revealed the NSA's 
warrantless wiretapping, in which he made a rare reference to the emergency 
program: The Justice Department's legal reviews of the NSA activity, Bush said, 
were based on "fresh intelligence assessment of terrorist threats to the 
continuity of our government." 

It is noteworthy that two key players on Bush's national security team, 
Cheney and his chief of staff, David Addington, have been involved in the 
Continuity of Government program since its inception. Along with Donald Rumsfeld, 
Bush's first secretary of defense, both men took part in simulated drills for the 
program during the 1980s and early 1990s. Addington's role was disclosed in 
"The Dark Side," a book published this month about the Bush administration's war 
on terror by New Yorker reporter Jane Mayer. In the book, Mayer calls 
Addington "the father of the [NSA] eavesdropping program," and reports that he was the 
key figure involved in the 2004 dispute between the White House and the 
Justice Department over the legality of the program. That would seem to make him a 
prime witness for a broader investigation. 

Getting a full picture on Bush's intelligence programs, however, will almost 
certainly require any sweeping new investigation to have a scope that would 
inoculate it against charges of partisanship. During one recent discussion on 
Capitol Hill, according to a participant, a senior aide to Speaker Pelosi was 
asked for Pelosi's views on a proposal to expand the investigation to past 
administrations, including those of Bill Clinton and George H.W. Bush. "The 
question was, how far back in time would we have to go to make this credible?" the 
participant in the meeting recalled. 

That question was answered in the seven-page memo. "The rise of the 
'surveillance state' driven by new technologies and the demands of counter-terrorism 
did not begin with this Administration," the author wrote. Even though he 
acknowledged in interviews with Salon that the scope of abuse under George W. Bush 
would likely be an order of magnitude greater than under preceding presidents, 
he recommended in the memo that any new investigation follow the precedent of 
the Church Committee and investigate the origins of Bush's programs, going as 
far back as the Reagan administration. 

The proposal has emerged in a political climate reminiscent of the Watergate 
era. The Church Committee was formed in 1975 in the wake of media reports 
about illegal spying against American antiwar activists and civil rights leaders, 
CIA assassination squads, and other dubious activities under Nixon and his 
predecessors. Chaired by Sen. Frank Church of Idaho, the committee interviewed 
more than 800 officials and held 21 public hearings. As a result of its work, 
Congress in 1978 passed the Foreign Intelligence Surveillance Act, which 
required warrants and court supervision for domestic wiretaps, and created 
intelligence oversight committees in the House and Senate. 

So far, no lawmaker has openly endorsed a proposal for a new Church 
Committee-style investigation. A spokesman for Pelosi declined to say whether Pelosi 
herself would be in favor of a broader probe into U.S. intelligence. On the 
Senate side, the most logical supporters for a broader probe would be Democratic 
senators such as Patrick Leahy of Vermont and Russ Feingold of Wisconsin, who 
led the failed fight against the recent Bush-backed changes to FISA. (Both 
Feingold and Leahy's offices declined to comment on a broader intelligence 
inquiry.) 

The Democrats' reticence on such action ultimately may be rooted in 
congressional complicity with the Bush administration's intelligence policies. Many of 
the war on terror programs, including the NSA's warrantless surveillance and 
the use of "enhanced interrogation techniques," were cleared with key 
congressional Democrats, including Pelosi, Senate Intelligence Committee chairman 
Rockefeller, and former House Intelligence chairwoman Jane Harman, among others. 

The discussions about a broad investigation were jump-started among civil 
liberties advocates this spring, when it became clear that the Democrats didn't 
have the votes to oppose the Bush-backed bill updating FISA. The new 
legislation could prevent the full story of the NSA surveillance programs from ever 
being uncovered; it included retroactive immunity for telecommunications companies 
that may have violated FISA by collaborating with the NSA on warrantless 
wiretapping. Opponents of Bush's policies were further angered when Democratic 
leaders stripped from their competing FISA bill a provision that would have 
established a national commission to investigate post-9/11 surveillance programs. 

The next president obviously would play a key role in any decision to 
investigate intelligence abuses. Sen. John McCain, the Republican candidate, is 
running as a champion of Bush's national security policies and would be unlikely to 
embrace an investigation that would, foremost, embarrass his own party. 
(Randy Scheunemann, McCain's spokesman on national security, declined to comment.) 

Some see a brighter prospect in Barack Obama, should he be elected. The plus 
with Obama, says the former Church Committee staffer, is that as a proponent 
of open government, he could order the executive branch to be more cooperative 
with Congress, rolling back the obsessive secrecy and stonewalling of the Bush 
White House. That could open the door to greater congressional scrutiny and 
oversight of the intelligence community, since the legislative branch lacked 
any real teeth under Bush. (Obama's spokesman on national security, Ben Rhodes, 
did not reply to telephone calls and e-mails seeking comment.) 

But even that may be a lofty hope. "It may be the last thing a new president 
would want to do," said a participant in the ongoing discussions. 
Unfortunately, he said, "some people see the Church Committee ideas as a substitute for 
prosecutions that should already have happened."

 Federal lawmakers are scrutinizing the Homeland Security Department's role 
in efforts by Maryland State Police to spy on peace activists and death penalty 
protesters, raising concerns that the operations were supported with federal 
dollars.

Rep. Bennie G. Thompson, chairman of the House Homeland Security Committee, 
asked the department yesterday for a "full accounting" of actions by the state 
police and of any federal funding it provided to the law enforcement agency. 
In a letter to Michael Chertoff, the department secretary, Thompson questioned 
whether the covert operations violated constitutional safeguards.

The state police have come under fire for surveillance conducted on protest 
groups in 2005 and 2006 during the administration of Gov. Robert L. Ehrlich Jr. 
Documents detailing those activities were released last week by the American 
Civil Liberties Union, which had filed a lawsuit seeking the information. The 
state General Assembly is also planning hearings on the matter.

"These allegations are extremely troublesome and bring to light past domestic 
covert operations, which were found to be not only unconstitutional but also 
damaging to the rule of law and America's democratic principles," Thompson, a 
Mississippi Democrat, wrote in his letter. He added that funding of the state 
police actions with federal taxpayer dollars would constitute "a waste of 
valuable resources, both human and financial."

Members of the Maryland delegation including Rep. Steny H. Hoyer, the House 
majority leader, and Rep. Elijah E. Cummings, a Baltimore Democrat, expressed 
support for the congressional scrutiny.

"I was shocked that the state of Maryland ... would have that kind of 
activity going on," Cummings said. "And it makes me wonder how all of this came 
about. Is this truly in the name of homeland security? We must always protect our 
homeland, but we must also at the same time protect our constitutional rights."

The ACLU and civil liberties activists have warned for years that the 
Homeland Security Department's efforts after the Sept. 11 terrorist attacks to give 
local law enforcement agencies a national security role could encourage 
unwarranted investigations of private citizens. ACLU officials have said the Maryland 
case is reminiscent of the FBI's infiltration of civil rights and anti-war 
groups decades ago.

"The Department of Homeland Security has for quite some time been seeking to 
enlist local law enforcement to become domestic surveillance agencies and has 
been pouring literally millions upon millions of dollars into them," said 
David Rocah, a staff attorney with the ACLU of Maryland.

"These local agencies then have a need to justify the extraordinary amount of 
funding that they are getting, and in the absence of actual terrorists, they 
have to find a terrorist under every rock," he said.

Col. Terrence B. Sheridan, the state police superintendent, has denied that 
any illegal actions have been taken by state police against lawful protesters. 
Gov. Martin O'Malley, a Democrat, has said the operations ended before he took 
office in January 2007.

State police spokesman Gregory Shipley said public safety concerns prompted 
the surveillance and that he had not been briefed on information regarding 
federal funding.

"In the future, this certainly will not occur unless there is some sort of 
illegal activity or criminal nexus that is part of the investigation," Shipley 
said. "There just won't be any intrusion unless that is present."

Ehrlich, a Republican, said in an interview on WBAL-AM that he was not asked 
to give approval for the surveillance but that an assistant attorney general 
assigned to the state police approved it. However, Raquel Guillory, a 
spokeswoman for Attorney General Douglas F. Gansler, said the state police never 
requested the agency's opinion on the matter.

A spokeswoman for the Department of Homeland Security declined to comment, as 
a matter of policy.

The Maryland operation has drawn scrutiny from several corners of Capitol 
Hill. Rep. Dennis J. Kucinich, who chairs a subcommittee of the House Committee 
on Oversight and Government Reform, said last week that he would investigate 
the surveillance.

The Ohio Democrat and former presidential candidate is known for his antiwar 
activism, his legislation to impeach President Bush and Vice President Dick 
Cheney, and his efforts to create a federal Department of Peace. He said he 
wants his subcommittee on domestic policy to determine the extent of the spying 
and who ordered it.

"Most people would be upset to know that police were spying on lawful 
citizens and infiltrating peaceful organizations, rather than chasing down real 
criminals," Kucinich said. "At a minimum, such police spying is clearly a waste of 
taxpayer dollars and a diversion from the mission of protecting and serving 
the people."

Cummings, a member of the subcommittee, wrote Kucinich yesterday to express 
his support.

"At a time when people across the United States believe their civil rights 
are being violated and question the credibility of our justice system, it is 
imperative that we make clear that this behavior will not be tolerated," the 
Baltimore Democrat wrote. Cummings said he has also asked O'Malley to review the 
matter.

According to the ACLU, which released 43 pages of state police summaries and 
computer logs, at least two undercover agents spent 288 hours monitoring and 
recording peaceful protest activities. During that time, agents infiltrated the 
Baltimore Pledge of Resistance, a peace group; the Baltimore Coalition 
Against the Death Penalty; and the Committee to Save Vernon Evans, a death row 
inmate.

The ACLU said that nothing in the documents indicated criminal activity or 
intent by the protesters. Police also entered the names of activists in a law 
enforcement database of people suspected of being terrorists or drug 
traffickers, the documents show.

Maria Allwine, a member of Baltimore Pledge of Resistance, said that she 
hopes congressional action will pressure state officials to release other 
information, including why the spying was ordered, and result in safeguards to prevent 
such surveillance. She said lawmakers should examine laws governing the 
release of public information, noting that her group has been trying to obtain 
answers through formal requests since 2006.

The thing that I thought was interesting is the new revelation out of the Gitmo trial that Flight 93 was shot down - a contradiction to the "official" story.

Who is Mike Flores? Interesting ... I didn't hear the movement split in 
half! What about the massive majority of "truthers" who know that both 
of these theories are just silly? This is fairly interesting--new 
attacks come at us from all angles. First time I've been associated with 
the theory that McCartney's dead, I have to admit :)

BTW, not necessarily a revelation at the Gitmo trial that 93 was shot 
down. The guy speaking (Navy office prosecutor) was quoting Hamdan (bin 
Laden's driver) in saying that it was shot down.

We contacted the Ron Paul Campaign and asked for an updated 
report on Ron Paul's status in the presidential race and his

To our surprise, we received word back from the campaign that 
they decided to take a pass.  Considering the media blackout

        A July 2 New York Times
article titled, ?China Inspired Interrogations at Guant?namo,? reported
that in December 2002 military trainers at Guant?namo Bay based an
entire interrogation class on a chart showing the effects of ?coercive
management techniques.? These techniques included ?sleep deprivation,?
?prolonged constraint,? and ?exposure.? According to the article, the
?chart was copied from a 1957 Air Force study of Chinese Communist
techniques used during the Korean War to obtain confessions, many of
them false, from American prisoners.?

              The 1957
article says these alleged methods are the same ones that ?inquisitors
had employed for centuries? and were nothing that ?was not common
practice to police and intelligence interrogators of other times and
nations.? But then it goes on to say that the chart is evidence that
?Communist interrogation methods? are the basis for the kind of torture
currently being done today by the U.S. military and the CIA.

              Albert
D. Biderman, a sociologist working for the Air Force, wrote an article
entitled, ?Communist Attempts to Elicit False Confessions from Air
Force Prisoners of War.? Biderman interviewed U.S. soldiers who had
been captured in the Korean War. Some of these GIs had been filmed by
their captors, confessing to the use of germ warfare and other
atrocities by the U.S.

              Did the U.S. carry out atrocities in the Korean War?
              Yes.
In fact, recently declassified U.S. documents and photographs reveal
that U.S. Army officers were aware of and in some instances supervised mass
executions?of as many as 200,000 people. U.S. soldiers carried out
indiscriminate massacres of civilians, including many women and
children. The U.S. dropped bombs, including napalm, on villages. (See
?Little Known Truth about the Korean War: Nightmare of Massacres by
U.S. and South Korean Troops,? Revolution #136, July 20,
2008.) And there is credible evidence that the U.S. was experimenting
with germ warfare in limited covert actions during the Korean War. (See

              But
when captured U.S. soldiers confessed to such crimes, the question
asked by the U.S. government wasn?t: was this actually true or not.
These ?confessions? were just declared ?false? and then the question
became: how were these American prisoners ?brainwashed? to say such
things? And on the basis of this, the U.S. military set out to find a
way to ?inoculate? U.S. soldiers against making such ?false
confessions.?
