That might be what happened, but that doesn't seem to be the issue in the
lawsuit.  The plaintiff claims to have been assigned the copyright of "certain
copyright-protected computer software programs and information contained therein
[…] known as the “ACS Atlas”".  They claim that Olson and Eggert have "unlawfully
reproduced" their copyrighted software.  They don't mention a book at all.
This seems wrong in ways too numerous to mention, but you can sue just about
anyone for just about anything for the price of hiring a lawyer and how these
things come out can be surprising often enough to maybe make it worth taking a
shot at it.
