Rogers Declared Unable To Transact Business

Boston, Mass., Sept. 18--Upon the evidence of members of the family of Henry H. Rogers, and the family physician, testimony that Rogers had suffered a stroke last July and since had been unable to transact any business, Judge Hammond in the supreme court today announced that it would be cruel to compel his attendance in court and dismissed the motion to that effect. The condition of Rogers was disclosed in the course of a hearing on motion to show that he was incapable of attending the trial of a suit against him for fifty million dollars brought by C. M. Raymond, of Somerville, for alleged conversion of certain royalties in connection with the production of petroleum.
