This question comes up on several lists over and over again. I am not a
copyright lawyer, nor do I play one on the internet....However, general
copyright law, as ith as been explained a few times, including once by a
copyright lawyer, tells us that these mags, even though out of print and the
museum who published them are out of business, are still protected as it is
likely that someone still holds the ownership of those intellectual property
rights. When the museum was liquidated, someone or some corporation took the
rights to those assets and is the legal owner. That person may or may not care
if the mags are reproduced, but that is not for us to decide here. Loaning them
to a friend, and he makes a copy for himself, is hardly a problem that will be
pursued. Using a pattern from the mag for a class that you teach and make a
profit from is clearly a violation. There is no "educational use" clause in
copyright law. Ask any school that has been prosecuted for violation of
copyright material!
