If the result of sending anything to list memebers via the list would result in "flaming" then what makes it right to send it to each individual using list e-mail addresses?

<IMHO he was probably right to send it privately.  

WRONG...  If a mail list only purpose is to provide a place where messages can be sent to groups of people, that could be done with a list of e-mail address posted on a web page.  I know I would not participate in that kind of thing.  Would you?
