Using reference photos from the general public is not a problem.   You are gathering reference material, not doing a specific portrait of a particular individual.  You are also not publishing the photos.   It could be a problem if you took a photo of someone with a marketable image--an actor, a ball player, and sold the carving as a portrait of that person--marketing their image for your gain.
